Marvin Jackson filed a lawsuit against the WWE on January 12, 2023 due to alleged loss of hearing in his left ear during WrestleMania 38 by a pyrotechnics blast. Jackson was reportedly seeking over $1,000,000 in monetary relief, including damages, penalties, costs, expenses, prejudgment interest and attorney’s fees, via a jury trial.

PWInsider.com reports that Jackson’s lawsuit against the WWE in regards to the injuries he sustained has been sent back to arbitration. The report also states that the District Court of Tarrant County, Texas, dismissed the lawsuit with prejudice, meaning Jackson could not revive it in the same court, and despite filing an appeal, he was advised to pursue arbitration for damages.

The United States Court of Appeals for the Fifth Circuit recently upheld a decision by the District Court of Tarrant County, Texas, where they support WWE’s argument that any disputes related to Jackson’s claims must be resolved through arbitration.
