As PWMania.com previously reported, ESPN and its subsidiary, BAMTech, have been added to the lawsuit over WWE’s transition of premium live events to the ESPN Unlimited App.
PWInsider.com has provided an update on the ongoing lawsuit and a recent motion favoring WWE. According to the report, the U.S. District Court in Connecticut ruled in favor of WWE’s motion to halt discovery against WWE, ESPN, and BAMTech, LLC. The lawsuit claims that WWE misled customers about how to watch its major premium live events after moving them to the ESPN Unlimited tier of the new ESPN App, starting with WrestlePalooza 2025 last year.
Discovery is the phase in a legal case where both parties are required to exchange evidence and open their records to each other. WWE argued in its motion that discovery should be paused until the court decides on the defendants’ attempts to move the lawsuit to private arbitration. The report noted that there is currently no deadline for the court to rule on whether the case will be moved to arbitration.
The lawsuit was filed earlier this year by Michael Diesa and Rebecca Tobak. As previously reported, ESPN and BAMTech are seeking to have the lawsuit moved to arbitration, while the plaintiffs are requesting a jury trial.
